Types of cases that cannot be assisted in principle

The Legal Aid Foundation (LAF) does not provide assistance for the following types of cases without special approval from the president of the branch office.

Criminal matters

  1. Representation during trial for publicly-prosecuted crimes (representation for certain victims of crime during trial is excluded)
    The following victims of crime who apply for representation during trial proceedings are not subject to the above restriction:
    • Those who are unable to make complete statements due to structural impairment of the nervous system or impairment or deficiency in mental or psychological functions
    • Those who are victims of crimes with a statutory minimum prison sentence of three years or more, crimes against sexual autonomy, or human trafficking offenses
    • Those who are victims of other crimes that fall under the offenses specified in Article 455-38, Paragraph 1 of the Code of Criminal Procedure
  2. Filing criminal charges in court
  3. Representation in retrials and special appeals
  4. Filing private prosecution in court
  5. Prosecuting matters concerning rights in trademarks

Civil matters

  1. Election litigation
  2. Small claims and compulsory enforcement proceedings
  3. Matters for retrial
  4. Matters concerning rights in trademarks and patents

Administrative matters

  1. Retrials
  2. Matters concerning rights in trademarks and patents

Cases where the applicant has already received three grants of legal aid in the same year

Legal aid for corporations and organizations

Matters concerning trademarks or patents

Cases where the applicant has already received aid from other legal services providers

In cases where the applicant has already recieved legal aid from government agencies (institutions) or private organizations for cases regarding the same issue, the review committee shall deny aid in whole or in part, unless it determines that additional aid is necessary.
